General Conditions trains (RENFE)

This document establishes the conditions governing the hiring of trips for tourism purposes, in the Luxury Tourist Trains of RENFE Viajeros SA by national territory (Spain). These conditions apply to tourist trains Al Andalus, El Transcantábrico Grand Luxury, El Transcantábrico Classic and La Robla Express.

RENFE Viajeros will make available to the CLIENTS a catalog of tourist products depending on the type and route of their Tourist Trains throughout the year.

The CLIENT may request the hiring of these tourist products available at any time, according to 2 modalities:

a) Regular Trip: the journey of the train trip and the other services offered are carried out within the framework of the regular season of services of the chosen Tourist Train.

b) Charter Trip: these services are performed well outside the regular season of services of the selected Tourist Train or in regular season contracting the exclusivity of the train.

They will be provided, always at the request of the CLIENT, the approaches by conventional train AVE, ALVIA or Long Distance, to the starting point of the tour of the Tourist Train as well as the return from the end of the same, provided that the movements are direct between stations, are carried out within the limits of the national railway network, on consecutive dates and with a maximum difference of 48 hours between links if these were unavoidable. Renfe will offer a 50% discount on the general (flexible) rate for El Transcantábrico and Tren Al Andalus reservations by providing promotional codes (one code for every 2 people) applicable both for sale at the box office and through www.renfe.com

The maximum capacity of the rooms and the conditions of accommodation on board will comply with what is expressly established in the catalogs, the website and all those supports and communications issued for this purpose by RENFE Travelers.

If a traveler, on their own and under their responsibility, wishes to carry out an activity or modify a schedule outside the daily travel program, they must first inform the person in charge of issuing the train. Activities that may alter the program of the rest of the group or that impede the development of the work of the crew will not be allowed.

No animal is allowed on board the Tourist Trains, except guide dogs. RENFE Viajeros does not have spaces enabled for transport in cages.

All Luxury Tourist Trains, although remodeled and equipped with the latest technologies, are historical and vintage trains, so that its interior is not enabled and the movement of wheelchairs or walkers is not possible. In the case of people with reduced mobility, consult before making the reservation.

The CUSTOMER must pay as a "registration fee and guarantee of reservation", once the "BOOKING CONFIRMATION" is received, 40% of the total amount established for the booked tourist product, within the period of FOUR (4) calendar days If you are a resident in Spain or within SEVEN (7) calendar days if you reside abroad.

The remaining 60% to complete the total payment, at least thirty (30) days before the start date of the trip. On Charter Travel (consult).

The non-payment of the amounts resulting in these sections within the established deadlines will constitute a contractual breach of the CLIENT empowering RENFE Travelers to request the resolution of the contracted trip and request compensation based on the penalties provided for cancellation in section V of this document.

The prices of each tourist product, in its travel modalities, expressed in Euros, include everything that is expressly indicated on the website, the catalogs and all those supports and communications issued for that purpose by RENFE Travelers.

1. Cancellations

The CLIENT may cancel the requested services at any time, communicating in writing his withdrawal from the contracted trip, and having the right to the return of the amounts delivered, with the exception of 15% of the total amount of the reservation (always on the current retail price, without discounts) to be paid to the company as compensation.

The percentage to apply, always on the PVP in force, to know the amount to be paid as compensation, will be increased depending on the date of cancellation with respect to the date of commencement of the trip, as follows:

  • Cancellation between 30 and 15 days: 25%
  • Cancellation between 14 and 5 days: 50%
  • Cancellation between 4 and 1 day: 80%
  • Cancellation with less than 24 hours or no show on the day of the start of the trip: 100%

When you cancel your trip a CLIENT who has already paid the amounts as a "registration fee / guarantee reservation", before proceeding with the return of these amounts RENFE Travelers will be authorized to deduct the compensation established in section III.1. In the cases in which the CLIENT has not expressly communicated his withdrawal and has not complied, in due time, with the payments of the established amounts, RENFE Viajeros will be entitled to apply and claim to the CLIENT the compensation amounts based on the percentages established in section III.1., which must be paid within a maximum period of THIRTY (30) days from the date of the requirement that RENFE will make for the appropriate purposes.

2. Changes

All changes must be communicated in writing.

a) Changes in the date of travel: The percentage to be applied, always on the PVP in force, to know the amounts to be paid as compensation, will be increased depending on the date of communication of the change with respect to the travel start date, as follows:

  • Communicated changes are accepted more than 120 days in advance.
  • Communicated between 120 and 31 days in advance: 10% compensation.
  • No changes are allowed on the date of the trip less than 31 days before the trip departure date.

b) Changes in the identity of the passengers:

  • Changes in the identity of one of the two passengers traveling in a double room are allowed up to 5 days before the date of departure.
  • Changes in the identity of the two passengers traveling in a double room or of the passenger traveling in a single room are not allowed. Such changes will be considered cancellations.

1. Before the trip departure

If RENFE Travelers is obliged to modify some essential element of the contracted Trip, it will be immediately communicated to the CLIENT. The CLIENT, upon receipt of the communication, will have the power to terminate the contract and all the amounts paid on account, or accept the modification that will become part of the binding contractual conditions between the parties.

For these purposes, the modification of essential elements is not considered: the change of one visit for another of similar characteristics; the alteration of the schedules or the chronological order of the visits; the change of the location of the places of food or overnight in the itinerary of the trip; the replacement of the means of transport on a specific route; the variation of shows and performances.

If for technical or organizational reasons RENFE Travelers is in need of suspending the trip, it will be obliged to offer the traveler a new date or the refund of the amount.

2. After the start of the trip

The itineraries may be subject to modifications, due to circumstances beyond the control of the Organizer or to different problems that could arise in an abnormal operation in the management of the capacity of the network in which the Tourist Trains circulate. In these cases, the Organizer will adopt the appropriate solutions for the continuation of the organized trip, without any additional cost to the client, and communicating them to it.

If the CLIENT continues the journey with the solutions provided by the Organization, it will be considered that he tacitly accepts these proposals.

RENFE Viajeros will respond to the CLIENT based on the obligations that correspond to it for its field of travel management, for the correct fulfillment of the obligations derived from the contract, regardless of whether they should be executed by the same or other service providers and without prejudice of the right of RENFE Viajeros to act against said service providers.

The responsibility of RENFE Viajeros will cease, as a result of the non-execution or defective execution of the contract, when any of the following circumstances concur:

That the defects are attributable to the CLIENT.

That are attributable to a third party, oblivious to the provision of the benefits provided for in the contract and have an unpredictable or insurmountable nature.

That is due to Force Majeure.

That the damages are due to an event that RENFE Viajeros, despite having put all the necessary diligence, could not foresee or overcome.

The compensation of the damages, where appropriate, due to non-compliance or poor performance of the benefits, will be limited to what is established in current national regulations.

RENFE Viajeros will not be liable to third parties for breaches of the CLIENT's obligations, except as expressly indicated in the regulations applicable to the case.

Luxury Tourist Trains only have the Mandatory Travelers Insurance (SOV). It is recommended to the CLIENT to hire a particular travel insurance that covers possible cancellation costs, accidents outside the train, illness or similar through their travel agency or insurer.

In accordance with the provisions of Article 90 of the Railway Sector Regulations, approved by Royal Decree 2387/2004

1. The railway company is empowered to exclude from its transport vehicles passengers who, with their conduct, alter the order within them or jeopardize transport safety. Access to transport vehicles and boarding or waiting rooms may also be denied to those who do not submit to the security controls established for passenger access to vehicles.

2. Without prejudice to the penalties that may apply for the offenses committed, excluded passengers will not be entitled to a refund of the price paid for the transport certificate.

Additionally, Regulation 1371/2007 of the European Parliament and of the Council on the Rights and Obligations of Railroad Travelers, in Article 9 Right to transport. Exclusion of transport, in its section 2 provides the following: 9.2 The general conditions of transport may provide that passengers who:

a) they represent a danger to the safety and proper operation of the operation or to the safety of other travelers;

b) that they bother the other travelers in an intolerable way, and that said persons will not be entitled to reimbursement of the price of transport or of the price they would have paid for the transport of their luggage.

In the event that as a result of the fulfillment of this contract, the parties need to exchange personal data, they commit themselves to the fulfillment of any obligations legally required by virtue of Organic Law 15/1999 of December 13, Protection of Personal Data and its development regulations, especially Royal Decree 1720/2007, leaving the other party undamaged at any time as many claims, penalties and others may be derived as a result of non-compliance with the aforementioned provisions.

Each of the parties will adopt as many security measures as may be necessary to ensure the security and integrity of such data that, where appropriate, access or be provided in compliance with the provisions of this contract, in accordance with the provisions in current regulations.

In case of any controversy related to the drafting of the documents related to the contracting of the services of Tourist Trains, and derived from the translation of the same to another language, the Spanish version will prevail.

These Conditions, together with the catalogs, budgets and other material generated for the contracting of tourist products of Tourist Trains by the CLIENT, represent a total and binding agreement between the parties.

The contracting of tourism products will be governed by the Conditions established in this document and in a subsidiary manner (and provided that it is not foreseen or in contradiction with the above) by the specific requirements contained in the catalogs, budgets and other material generated between the parties for hiring trips. In what is not expressly agreed, Spanish legislation will apply.

In cases of doubts or differences raised by the application or interpretation of the Contract Conditions, efforts shall be made to resolve them by mutual agreement between the Parties.

If said agreement of the controversy negotiations is not reached, both parties agree to submit it to the knowledge of the competent Courts and Tribunals of Madrid Capital, with the express resignation of the parties to any other jurisdiction that may correspond to them.
